Risk Disclaimer — Visual Sectors

This disclaimer forms part of the Terms of Service. It applies to every reading, figure, chart and page the Visual Sectors platform at visualsectors.com shows you — Workflows, the Screener, Options Indicators and News & Sentiment alike.

The Visual Sectors Data API at api.visualsectors.com is a separate product and carries its own disclaimer.


1. Information, not advice

Everything the Service provides is information. None of it is advice.

Visual Sectors does not provide investment advice, financial advice, tax advice, legal advice or accounting advice. Nothing the Service returns — no dataset, no indicator, no level, no backtest, no statistic, and nothing in the documentation — is:

The Service knows nothing about you. It has no information about your objectives, your financial position, your tax status, your existing holdings or your capacity to bear loss, and it makes no assessment of whether anything is appropriate or suitable for you.

Using the Service does not make us your adviser, broker or fiduciary, and creates no such relationship. If you need advice, take it from someone authorised to give it in your jurisdiction.


2. The data may be wrong

Market data is difficult and imperfect. You should assume that at any given moment the Service may return data that is:

Parts of the data come from third-party sources. We do not independently verify them and we cannot guarantee their accuracy, completeness or timeliness.

Verify anything you intend to act on against a primary source. Do not build a process that would cause you loss if a single response were wrong, late or absent.


3. Derived indicators are models, not observations

Some of what the Service returns is not measured — it is calculated by us from other data, using a methodology of our choosing. Support and resistance levels, technical indicators, sentiment reads, regime classifications and the proprietary options indicators are all of this kind.

A model output is an opinion expressed as a number. It depends on the assumptions built into it, on the quality of the inputs, and on market conditions resembling those the method was developed for. A different, equally reasonable method would produce different numbers. The methodology documentation describes what we do and why; it is not a claim that the result is correct.


4. Backtests, hold rates and historical statistics

The Service returns historical performance statistics — including level backtests and hold rates, on the free tier.

These describe what happened in the past. They do not predict what will happen next.

Specifically:

We make no representation that any level, indicator or statistic will be profitable, or will work at all.


5. Regulatory status

Visual Sectors, Inc. is not registered with the U.S. Securities and Exchange Commission as an investment adviser, and is not a broker-dealer registered with the SEC or a member of FINRA or SIPC. It is not authorised or regulated by the Financial Conduct Authority in the United Kingdom, and holds no equivalent authorisation in any other country.

We do not hold client money, we do not hold or custody securities, we do not execute or transmit orders, and we do not manage anyone's portfolio.

The Service is a data and documentation service. It is not a regulated financial service, and nothing in it is intended as a financial promotion, a personal recommendation, or an inducement to engage in investment activity.


6. Risk

Trading and investing carry risk, including the risk of losing more than you put in where leverage or derivatives are involved.

Options in particular can lose their entire value quickly, and strategies involving them can produce losses that exceed the initial outlay. Several of the datasets in the Service are options-derived. Their presence is not encouragement to trade options.

Markets can move sharply, liquidity can disappear, and instruments can be suspended or delisted. Do not risk money you cannot afford to lose.


7. Your decisions are yours

You are solely responsible for any decision you make and any action you take, whether or not it followed from something the Service returned. That includes any automated system you build on the Service: an automated strategy built on what you read here is your system, not ours, and its behaviour, its risk controls and its failures are yours.

To the extent permitted by law, Visual Sectors accepts no liability for any trading or investment loss arising from use of, or reliance on, the Service. The limits and exclusions in Terms of Service §10 apply.


8. Availability of the Service in your country

The Service is not directed at any person in any jurisdiction where it would be unlawful to provide it, or where doing so would require us to hold a licence we do not hold. If you access it from such a place, you do so on your own initiative and are responsible for compliance with local law.
